What Happened?
The lawsuit alleges that the emission levels in certain Hino trucks were misrepresented and exceeded regulatory limits, damaging purchasers and lessees of the vehicles. 

What Does That Mean?
All persons or entities that purchased or leased Settlement Class Truck (see below for illustrative list) through October 30, 2023 could be eligible for a cash payment.

  • Hino XL8 (Model Year 2020)

  • Hino L6 (Model Year 2021)

  • Hino L7 (Model Year 2021)

PLEASE NOTE: If you have more than one eligible vehicle, you must submit a separate Claim Form for each vehicle. If you need to file Claims for more than 10 vehicles, please contact info@classactconnect.com for assistance in filing your Claim.

What Does This Mean? 
Estimated compensation for each eligible Settlement Class Truck could likely be between $1,500 to $15,000 per Class Truck, depending on the number of claims submitted and court-awarded fees and costs. Valid claim filers could also receive:

  1. A robust extended warranty: covering the repair or replacement of various emission control system component parts, including the cost of any diagnostic test leading to the repair; and 

  2. A New Parts Warranty: if there is a government-mandated or government-recommended emissions system recall or repair campaign involving the Settlement Class Trucks in the next three years.

What is the background on this lawsuit? Why is there a Settlement?

The Plaintiffs allege that Defendants took part in schemes to manipulate emissions test results for certain Hino-branded trucks in the United States, which Plaintiffs allege harmed purchasers and lessees of the Settlement Class Trucks. This means that all persons or entities that purchased or leased Settlement Class Truck through October 30, 2023 could be eligible for a cash payment.

The Court has not ruled in favor of either Plaintiffs or the Defendant. Instead, both sides have agreed to a settlement. By agreeing to the Settlement, the parties avoid the costs and uncertainty of a trial, and if the Settlement is approved by the Court, Settlement Class Members who submit timely and valid claim forms will receive a Settlement Payment, as described in this Notice. Defendant denies all legal claims in this case. Plaintiffs and their lawyers think the proposed Settlement is best for everyone who is affected.

Excluded from the Settlement Class are: (i) Defendants’ officers, directors, and employees; (ii) Defendants’ affiliates and affiliates’ officers, directors, and employees; (iii) Defendants’ distributors and distributors’ officers, directors, and employees; (iv) Released Parties; judicial officers and their immediate family members and associated court staff assigned to this case; and (v) all those otherwise in the Settlement Class who or which timely and properly exclude themselves from the Settlement Class.

How much money will I receive?

Settlement Class Members who timely file with an Approved Claim will receive a settlement payment from the $237.5 Million Settlement Fund that pays for:

(1) all settlement payments,
(2) all settlement administration expenses,
(3) all taxes and tax expenses,
(4) any service awards to the class representatives, and
(5) any fee award to class counsel.

The Settlement Administrator estimates that the compensation available for each Settlement Class Truck is likely to range from $1,500 to $15,000 per Class Truck, depending on the volume of claims submitted and court-awarded fees and costs.

If more than one Settlement Class Member submits a valid Settlement Claim for the same Settlement Class Truck, then 60% of the compensation for that Settlement Class Truck will be allocated to the original owner who purchased the truck new, and the remaining 40% will be allocated to or divided evenly among the other Settlement Class Member(s) that submit a valid Settlement Claim for that same truck. 

Additionally, Eligible Claimants may receive:
(1) A robust extended warranty that covers the repair or replacement of various emission control system component parts, including the cost of any diagnostic test leading to the repair; and
(2) A New Parts Warranty if there is a government-mandated or government-recommended emissions system recall or repair campaign involving the Settlement Class Trucks in the next three years.

How do I pay CAC for their services?

There is no risk when you file through Class Action Connection – we do not charge any upfront fees for our services. When the Claims Administrator distributes settlement funds, we simply deduct a recovery fee of 20% from the settlement payment.
