What is the background on this Payment Card lawsuit? Why is there a Settlement?

The lawsuit is about claims that merchants paid excessive fees to accept Visa and Mastercard cards because Visa and Mastercard, individually, and together with their respective member banks, violated the antitrust laws.

The Court has not ruled in favor of either Plaintiffs or the Defendant. Instead, both sides have agreed to a settlement. By agreeing to the Settlement, the parties avoid the costs and uncertainty of a trial, and if the Settlement is approved by the Court, Settlement Class Members who submit timely and valid claim forms will receive a Settlement Payment, as described in this Notice. Defendant denies all legal claims in this case. Plaintiffs and their lawyers think the proposed Settlement is best for everyone who is affected.

Who is eligible for this settlement?

All persons, businesses, and other entities that have accepted any Visa-Branded Cards and/or Mastercard-Branded Cards in the United States at any time from January 1, 2004 to January 25, 2019 are eligible for this settlement.

Excluded from the Settlement Class are: (i) the Dismissed Plaintiffs, (ii) the United States government, (iii) the named Defendants in this Action or their directors, officers, or members of their families, or (iv) financial institutions that have issued Visa-Branded Cards or Mastercard-Branded Cards or acquired Visa-Branded Card transactions or Mastercard-Branded Card transactions at any time from January 1, 2004 to January 25, 2019.

How much money will I receive?

Settlement Class Members who timely file with an Approved Claim will receive a settlement payment equal to a pro rata share of the $5.54 Billion Settlement Fund that pays for:

  1. All Settlement Payments

  2. All Settlement Administration Expenses

  3. All Taxes and Tax Expenses

  4. Any Service Awards to the Class Representatives, and

  5. Any Fee Award to Class Counsel.

The Class Administrator has data from Defendants and others and intends to utilize it to estimate the total value of interchange fees attributable to each Authorized Claimant during the settlement period, where available. Where that data isn’t reasonably available, or the data is disputed by the class member, the class member is required to submit additional information to support their claim. This split is determined on all merchants’ pro rata share of the Settlement fund, no payments are expected to be made until after the end of the claims period of May 31, 2024.
