What is the background on this lawsuit? Why is there a Settlement?

Grande Cosmetics (“Grande”) failed to disclose information regarding GrandeLASH-MD, GrandeBROW, and GrandeHAIR, including that an ingredient, Isopropyl Cloprostenate, is a prostaglandin analog which poses undisclosed risks of adverse reactions.

The Court has not ruled in favor of either Plaintiffs or the Defendant. Instead, both sides have agreed to a settlement. By agreeing to the Settlement, the parties avoid the costs and uncertainty of a trial, and if the Settlement is approved by the Court, Settlement Class Members who submit timely and valid claim forms will receive a Settlement Payment, as described in this Notice. Defendant denies all legal claims in this case. Plaintiffs and their lawyers think the proposed Settlement is best for everyone who is affected.

Who is eligible for this settlement?

You are a member of the “Settlement Class” affected by the Settlement if you purchased GrandeLASH-MD, GrandeBROW, or GrandeHAIR from Grande for personal, family, household, or professional purposes between January 1, 2018 and December 14, 2023.

How much money will I receive?

There are two scenarios for this settlement:

  1. WITHOUT PROOF:

    • Consumers who file without proof of purchase are entitled to a maximum payout of $150 in cash.

  2. WITH PROOF OF PURCHASES OF TWO ENHANCED SERUMS:

    • Consumers may be entitled to an additional benefit of up to $150.00 in cash, should they submit proof of purchase of at least two purchased of Enhanced Serums.

    • This additional benefit, which may or may not be available depending on remaining funds, is an amount in addition to the Cash Benefit of up to $150.00 that Authorized Claimants may obtain without proof of purchase.

The final payouts (including the additional up to $150.00 in cash for proof of two purchases) may vary depending on 1) how many eligible customers file their claim forms and 2) the remaining funds from the $6.25 Million Settlement Fund that pays for:

  1. All Settlement Payments

  2. All Settlement Administration Expenses 

  3. All Taxes and Tax Expenses 

  4. Any Service Awards to the Class Representatives, and 

  5. Any Fee Award to Class Counsel.

Do I Need to File a Claim with Class Action Connection?

No, you can always file a claim on your own. If you are a Settlement Class Member, you must complete and submit a valid Claim Form in order to receive a payment. To be valid, a Claim Form must be completed fully and accurately signed under penalty of perjury and timely submitted

You may submit a Claim Form by U.S. mail or file a Claim Form on the Settlement Website. If you send in a Claim Form by U.S. mail, it must be postmarked no later than February 27, 2024. If you file a Claim Form on the Settlement Website, then you must do so by February 27, 2024.
