What is the background on this lawsuit? Why is there a Settlement?

This class action alleges allege that Defendants (listed below) and their co-conspirators conspired and combined to fix, raise, maintain, and stabilize the price of Pork products with the intent and expected result of increasing prices of Pork products in the United States, in violation of federal and state consumer and antitrust laws. Defendants deny these allegations.

Settling Defendants:
Clemens Food Group, LLC, The Clemens Family Corporation, and Hatfield Quality Meats, Inc. (the “Clemens Defendants”); Hormel Foods Corporation; JBS USA Food Company and JBS USA Food Company Holdings (the “JBS Defendants”); Seaboard Foods LLC; Smithfield Foods, Inc. (the “Smithfield Defendants”); Triumph Foods, LLC; Tyson Foods, Inc., Tyson Prepared Foods, Inc., and Tyson Fresh Meats, Inc. (the “Tyson Defendants”) and Agri Stats, Inc.

The Court has not ruled in favor of either Plaintiffs or the Defendant. Instead, both sides have agreed to a settlement. By agreeing to the Settlement, the parties avoid the costs and uncertainty of a trial, and if the Settlement is approved by the Court, Settlement Class Members who submit timely and valid claim forms will receive a Settlement Payment, as described in this Notice. Defendant denies all legal claims in this case. Plaintiffs and their lawyers think the proposed Settlement is best for everyone who is affected.

Who is eligible for this settlement?

All persons and entities who indirectly purchased raw pork bacon, or one or more of the following types of raw pork, whether fresh or frozen: bellies, loins, shoulder, ribs, or pork chops from defendants or co-conspirators for personal consumption, here they purchased this chicken in the following states or districts:

Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah, and West Virginia.

You are a member of the “Settlement Class” affected by the Settlement if you purchased the defined chicken products for personal consumption in the select states or districts between June 28, 2014, to June 30, 2018.

The final payout will vary based on customer’s pro rata portion of the fund based on their broiler chicken purchases during the Class Period. That will depend on how many eligible customers file their claim forms from the $75 Million Settlement Fund that pays for:

  1. All Settlement Payments

  2. All Settlement Administration Expenses 

  3. All Taxes and Tax Expenses 

  4. Any Service Awards to the Class Representatives, and 

  5. Any Fee Award to Class Counsel.

How do I pay CAC for their services?

You may submit a Claim Form by U.S. mail or file a Claim Form on the Settlement Website. If you send in a Claim Form by U.S. mail, it must be postmarked no later than April 2, 2024. If you file a Claim Form on the Settlement Website, then you must do so by April 2, 2024.
