What is the background on this lawsuit? Why is there a Settlement?

The lawsuit is about claims that Verizon Wireless (“Verizon”) charged a monthly Administrative Charge and/or Administrative and Telco Recovery Charge (collectively, “Administrative Charge”) on Verizon post-paid individual consumer wireless accounts that was unfair and not adequately disclosed.

The Court has not ruled in favor of either Plaintiffs or the Defendant. Instead, both sides have agreed to a settlement. By agreeing to the Settlement, the parties avoid the costs and uncertainty of a trial, and if the Settlement is approved by the Court, Settlement Class Members who submit timely and valid claim forms will receive a Settlement Payment, as described in this Notice. Defendant denies all legal claims in this case. Plaintiffs and their lawyers think the proposed Settlement is best for everyone who is affected.

Who is eligible for this settlement?

Current and former Verizon customers who had a postpaid wireless or data service plan and were charged an "Administrative Charge and/or an Administrative and Telco Recovery charge" between Jan. 1, 2016, and Nov. 8, 2023, are eligible to receive compensation under the settlement, the settlement agreement shows.

The “Settlement Class” includes consumers residing in the United States (based on account holders’ last known billing address) who received postpaid wireless or data services from Verizon and who were charged and paid an Administrative Charge between January 1, 2016 and November 8, 2023. Postpaid wireless plans are those in which holders pay for services at the end of a monthly billing cycle.

How much money will I receive?

For eligible Verizon customers, the initial payout will start at $15.00 for your account plus $1.00 for each month your account received postpaid wireless or data services from Verizon and was charged and paid an Administrative Charge and/or an Administrative and Telco Recovery Charge between January 1, 2016 and November 8, 2023, up to a maximum initial allocated amount of $100.00. The final payout will also depend on how many eligible customers file their claim forms from the $100 Million Settlement Fund that pays for:

  1. All Settlement Payments

  2. All Settlement Administration Expenses 

  3. All Taxes and Tax Expenses 

  4. Any Service Awards to the Class Representatives, and 

  5. Any Fee Award to Class Counsel.

How do I pay CAC for their services?

To be valid, a Claim Form must be completed fully and accurately signed under penalty of perjury and timely submitted

You may submit a Claim Form by U.S. mail or file a Claim Form on the Settlement Website. If you send in a Claim Form by U.S. mail, it must be postmarked no later than April 15, 2024. If you file a Claim Form on the Settlement Website, then you must do so by April 15, 2024.
